The ROC is a joke and Investigator David Fagerburg even more so!

We hired a very dishonest contractor to build a casita and a swimming pool. From the very beginning he lied to us and we later found out even his advertising was a lie-he advertised he had been in business for 20 years when he had only been in business 5 years. His girl friend pretended to be his wife even using his last name instead of her legal last name. The list of his illegal actions is extensive:

He changed the pool contract required by the Arizona legislature changing the payment terms in amount and timing. He then insisted we pay the larger amount when it was not due and walked off the job when we refused. According to the law failing to use the required contract language in and of itself is grounds for disciplinary action by the ROC.

He hired unlicensed subcontractors to do the electrical, plumbing, and HVAC and after being told this was illegal the contractor hired an unlicensed sub to do the plumbing and electrical on the pool.

The contract specifically provided that Pentair pool equipment, for which we were charged, would be provided. He changed the equipment to Hayward without our permission or consent. He even failed to install a drain which was purchased at our expense.

He ordered excessive amounts of material at our expense which was then removed from the job by his employees.

He never once came to the job site, our home, to supervise or even look at the job.

The only time he contacted us was by email us in order to call us filthy vulgar names.

The casita was to be built within 6 months but it took a year.

When the pool was 2 months behind schedule, because he refused to work on it unless we paid the money that was not due, we served a “Notice Of Default.” By the terms of the contractor’s own contract he then had 2 weeks to substantially finish the pool or the contract was terminated. He did nothing so the contract was automatically terminated.

The day after he was served with our Complaint to the ROC our home was vandalized when paint was thrown onto and over the new back wall.

You would think that even a portion of the the above would warrant sanctions against this dishonest contractor. However, the ROC Investigator, David Fagerburg, dismissed our complaint because he believed that the contractor should have been paid even though he was in default of the contract and it was terminated. Unbelievably Fagerburg even told us he believed the vandalism was done by the contractor but still gave him a pass to engage in this kind of conduct.

If you end up having to look to the ROC for help you are probably screwed. We can guarantee that if David Fagerburg is assigned to investigate your Complaint you are definitely screwed. What a ripoff of the good taxpayers of Arizona.

the abuse of power is unbelievable
i guess they get a bonus not sure
they will protect the roc contractor
a little advise
get a not roc contractor
if they mess up they will go hard on them for not paying them their cut
i had a problem
with
east valley insulation

when we finally had the meeting they looked at each other like great friends

Ofelia Velasco was absolutely amazing the entire process. She was extremely helpful and made sure to check in on me every few days to make sure I had the correct paperwork sent over. Extremely smooth process on their end. Great work, thank you for making this a good experience.

Contractor installed a full covered patio. Installed about 8 screws to hold a 27x30 roof to posts. Well the roof totally blew off after 4 months and the ROC states that he put the roof on and put in a few screws...aluminum to aluminum..might as well have used foil..and did the minimum requirements so we are SOL... The contractor did not even show up for the meeting with the ROC inspector and I have multiple messages from him stating he would fix the damage and the ROC did not even care. I asked for a second review on this. Never received a response..

Solar detach and reset broke almost 3 pallets of tile during an R&R. Due to tile being old, the color wasn't available. Solar company admitted to breaking the tile but blamed it on the tile being fragile. Both roofing company and tile company said tile was walked on wrong. ROC did make the solar company replace the tile (alf wrongly installed flashings but not replace the underlayment since i don't have a leak...yet) but due to minimal standard requirements it doesn't matter that about 1/4 to 1/3 of my took roof is a different color due to poor workmanship. Companies know they can make empty promises because the ROC only goes by minimal standard. Doesn't help that the solar company and ROC schmooze it up together
