Terms of Use

These Terms of Use form a binding agreement between you and BuildX Construction, Inc. ("ContractorsNearMe.ai", "we", "us") for the consumer marketplace at ContractorsNearMe.ai. The marketplace is self-serve: customers submit requests and compare pros, and pros claim listings and buy plans through checkout. By using the service you accept these Terms.

• Customers: people or businesses shopping for contractor services.
• Pros: contractors, suppliers, and other businesses with listings.
• Lead Request: a service request a customer submits, including contact and project details.
• Listing: a public pro profile with business details, reviews, and photos.
• Content: reviews, responses, photos, messages, and anything users submit.

ContractorsNearMe.ai introduces customers and pros. We are not a party to any contract between a customer and a pro, and we do not perform, warrant, or supervise any project work. Hiring decisions are yours. Verify licenses, insurance, references, and written quotes before work begins.

Verification badges and checks reflect a point in time and the sources available to us. They are not a guarantee of quality, licensing status, or future conduct.

• You must be 18 or older and provide accurate information.
• You keep your sign-in credentials private and are responsible for activity on your account.
• One account per person or business unless we approve otherwise.
• Tell us promptly about unauthorized access at legal@mybuildx.com.

Submitting a Lead Request shares your name, contact details, and project details with matched pros. You consent to be contacted by those pros about your request by phone, text message (SMS), and email, including automated means. Consent is not a condition of any other purchase.

Reply STOP to any text to opt out of further texts from that sender for that thread. Message and data rates may apply. Keep your contact details current so pros can reach you.

• Claiming a listing requires verifying you are authorized to act for the business.
• Keep listing details truthful and current: trade, service areas, contact details, license numbers, and business name.
• Do not claim a business you do not represent or submit false license information.
• We may unpublish or correct listings with false, stale, or unverifiable information.
• Paid plans add visibility and features. Checkout terms control over any plan summary. See Section 8.

Reviews keep the marketplace honest. By submitting Content you represent it is your own work, truthful to your experience, and owned or licensed by you.

• No fake reviews: do not post reviews for work that never happened, reviews you were paid to write, or reviews of your own business or competitors posed as customers.
• No paid positivity: do not offer or accept payment, discounts, or gifts in exchange for positive reviews or for removing negative ones.
• Business responses: pros may respond once per review, factually and without disclosing the reviewer's private details. No threats, no retaliation, no doxxing.
• Photo rights: only upload photos you took or have rights to share. You grant us a license to display them with the related listing or review.
• Moderation: we may edit formatting, or remove Content that breaks this policy, is unlawful, or is the subject of a verified court order or takedown.

• Browsing, requesting, and reviewing are free for customers.
• Pro plans and features are sold through self-serve checkout processed by our payment provider. Plan pages summarize; the checkout order form controls price, term, and features if they differ.
• Subscriptions renew automatically until canceled. Cancel in your account; access continues to the end of the paid period.
• Prices exclude taxes. You are responsible for applicable taxes except where we collect them at checkout.
• Refunds are handled per the plan terms shown at checkout. Chargebacks for valid charges may lead to suspension.

You must not:

• Break the law or infringe anyone's rights.
• Submit false listings, reviews, credentials, or project details.
• Scrape, harvest contacts, or mass-copy directory data.
• Spam, harass, or threaten any user or pro.
• Upload malware or interfere with the service.
• Circumvent access controls, rate limits, or verification.
• Misrepresent affiliation with us or any business.
• Use the service to train competing scraping or lead models against our terms.

We own the marketplace software, design, trademarks, and compiled directory presentation. You own your Content, subject to the license needed to display it. Suggestions and feedback may be used freely without compensation or confidentiality.

Checkout, email delivery, and sign-in run through third-party providers (see Privacy Policy). Their own terms may apply. Linked pro websites and outside quotes are not ours and we are not responsible for them.

The service is provided as is and as available. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We do not warrant uninterrupted listings, match quality, pro conduct, or project outcomes.

To the fullest extent the law allows, our total liability for any claim arising from the service is limited to the greater of (a) amounts you paid us in the 12 months before the claim, or (b) $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for acts of pros and customers you transact with.

You will indemnify and hold us harmless from claims, damages, and reasonable attorney fees arising from your Content, your use of the service, your transactions with other users, or your breach of these Terms. We will notify you promptly of a covered claim and cooperate at your expense.

• These Terms apply while you use the service.
• We may suspend or terminate accounts that breach these Terms, submit false information, or abuse the marketplace, with notice where the law requires it.
• You may close your account at any time. Closing stops future plan renewals but does not refund the current period except as the plan terms allow.
• Public reviews and responses may remain in anonymized form after closure as part of the marketplace record.

We will post updated Terms here with a new effective date. Material changes take effect 30 days after posting. Continued use after the effective date means you accept the updated Terms.

Contact legal@mybuildx.com first so we can try to resolve disputes informally within 30 days. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

• You may not assign your account without our consent. We may assign these Terms in a merger or sale.
• Notices to us go to legal@mybuildx.com. Notices to you go to your account email.
• Force majeure events excuse delayed performance other than payment.
• If part of these Terms is unenforceable, the rest stands. Export laws apply to software use.
• Sections 7, 10, 12, 13, 14, and 17 survive termination.
